In actions of assumpsit, it is usual to put in a count, commonly called a common count, for work and labor done, and materials furnished by the plaintiff for the defendant; and when the work was not done under a special contract, the plaintiff will be entitled to recover on the common count for work, labor, and materials. The name of one of the common counts in actions of assumpsit, being for work and labor done and materials furnished by the plaintiff for the defendant.
