UNCONTESTED DIVORCE

An automatic divorce granted by the court when the spouse served with divorce is served with a summons and complaint but fails to respond or make an appearance in court. It is also used to refer to divorces where both spouses have worked out their differences and there is no need for both spouses to go to court, pay court costs and litigate. The divorce proceeding is automatic, assuming the state requirements are met.
