SUBSTANTIVE DUE PROCESS

A constitutional prohibition against the infringement of personal liberties. According to the Fifth Amendment and the Fourteenth Amendment, the substance and the content of the law must be reasonable and fair and may not be applied against an individual in an arbitrary, unfair or unreasonable fashion. Substantive due process concerns the law. Procedural due process concerns legal procedure.
