INEFFECTIVE ASSISTANCE OF COUNSEL

Legal malpractice. A situation where a client was denied so right or a fair trial since an attorney committed errors so serious that the party never had a reasonable opportunity to obtain a fair hearing or trial. Typically involves a criminal defendant who claims that a court appointed lawyer committed negligence that led to an unfair trial where the defendant might have been acquitted had competent counsel been assigned.
