FORESEEABLE RISK

Typically refers to an affirmative defense by a defendant where the plaintiff had an assumption of risk by performing an act and therefore the defendant’s liability should be mitigated, e.g. the plaintiff went driving shortly after drinking alcohol and contributed significantly to an accident which was allegedly caused by the negligent driving of the defendant.
