EXCUSABLE NEGLECT

TheLaw.com Law Dictionary & Black's Law Dictionary 2nd Ed.

Typically referring to a legitimate reason for a party or counsel failing to meet a required deadline, usually a filing. It is usually used to set aside a default judgment that was entered as a result of ostensible neglect, e.g. the excuse being the party or the attorney was involved in a serious accident or was gravely ill at around the time of the deadline.
