In English practice. When the members of a court are equally divided on the argument showing cause against a rule nisi no order Is made i.e. the rule is neither discharged nor made absolute and the rule is said to drop. In practice there being a right to appeal It has been usual to make an order in one way the junior judge withdrawing his judgment.
