COMMERCIAL FRUSTRATION

Frustration meaning an event that is not foreseen or controllable which prevents (and excuses) a party to a contract from being able performing the party’s obligations or duties under the contract. For example, a lease can be terminated by a landlord if the rented premises burns down prior to entry and occupation by new tenants.
