ALLEN CHARGE

The Allen Charge is named after a famous case Allen v. United States,164 U.S. 492, 501-502, 17 S.Ct. 154, 41 L.Ed. 528 (1896). An Allen Charge is a set of instructions that are given to a jury when, after extensive deliberation by the jury, it reports back to the judge that it is deadlocked and unable to decide upon a verdict. This instruction is designed to encourage jurors to review and re-evaluate their opinions and make another attempt to reach a unanimous verdict.
