ACTUAL NOTICE

TheLaw.com Law Dictionary & Black's Law Dictionary 2nd Ed.

Notice that one actually receives expressly so there is no ambiguity as to whether or not the recipient received the notice and information. The actual (not implied) awareness of a fact, event or proceeding. A person may have actual notice of a court hearing when given papers in person by a process server (also known as personal service); this is as opposed to constructive notice where a person may be able to deduce from the circumstances that something should be occurring.
