WITNESSING PART

In a deed or other formal instrument, is that part which conies after the recitals, or, where there are no recitals, after the parties. It usually commences with a reference to the agreement or intention to be effectuated, then states or re-fers to the consideration, and concludes with the operative words and parcels, if any.
