WANT OF PROSECUTION

A motion made by a party for a judge to dismiss a lawsuit alleging that a litigant has purposefully and needlessly significantly delayed the prosecution of the claim and that, as a result, the entire case should be dismissed. For example, a defendant would make such an application claiming that the plaintiff doesn’t truly have a meritorious case and is using the lawsuit primarily as a method to needlessly harass the defendant.
