STATUTORY SHARE

State statutes may define the portion of the estate of a deceased person that another person is entitled to by law, and this term is usually used to describe the share a spouse may claim either 1/3 or 1/2 of the deceased spouse’s property. It may vary according to the number of children they have, how long they are married or other factors. Another name for the statutory share of the surviving spouse is dower and curtesy.
