RENT WITHHOLDING

When a tenant holds back paying full rent due to not receiving all the benefits of a lease, typically due to the landlord’s unjustifiable failure to remedy a significant problem for which the landlord is responsible to deliver under the lease. For example, a tenant withholds 5% of the rent after the landlord waits one full week to fix an issue where the tenant did not have hot water accessible.
