PENDENTE LITE

(A) Latin term meaning the action is pending and describes a matter which is dependent upon the outcome of a lawsuit, for example, money that may be paid into court pending the outcome of a lawsuit, which may be paid to the plaintiff if the plaintiff wins his or her case. (B) Pending the continuance of an action, while litigation continues. 2. An administrator is appointed, pendente lite, when a will is contested.
