A rule that still a majority of states subscribe to in which one spouse seeking the divorce must allege and prove that the other spouse is at fault for making the marriage untenable. Traditional fault grounds for divorce are adultery, cruelty, abandonment or desertion, confinement in prison, insanity and physical incapacity. Many states now have no-fault divorce in which no allegations of fault are required to obtain a divorce decree.
