EMOTIONAL DISTRESS

Emotional trauma, pain and suffering as a result of the experience of a harmful incident that was the result of the negligent or intentional act of another person or party. It is the basis for damages being awarded and no actual physical harm is required to be experienced by the plaintiff in order to recover for emotional distress damages, e.g. sexual harassment and defamation claims that may potentially cause significant emotional harm and distress to the victim.
