A defendant tortfeasor must accept the victim as is found. If a defendant is negligent and causes injury to a fragile plaintiff, the defendant still remains liable to the plaintiff to the full extent of the plaintiff’s injuries and damages. This is the case even though the resulting damages reached a greater level than that of a typical plaintiff who would not be as fragile.
