CEASE AND DESIST

An order or typical a letter (a Cease & Desist Letter or also known as a C&D) which is sent by a party which claims to hold a legal right against a second party, instructing the second party to stop, refrain, cease and desist of continuing a certain action. For example, a trademark owner may send a C&D Letter to an unscrupulous individual who is selling a product using the same trademarked brand name owned by the mark holder, ordering that person to immediately cease and desist the selling of products using the trademark of the owner. An judicial order mandates the cessation of the activity.
