ABUSE OF PROCESS

When a party uses the legal process inappropriately in order to inconvenience or harass another party other than for a bona fide settlement to dispute a claim. For example, one party may know it has no legal theory to win a dispute against a competitor. However, it will bring a claim to court in the hope of using its greater capital position to litigate the competitor into bankruptcy and out of business due to prolonged legal expenses defending the case.
